Welcome to Mitty Agritech.
These Terms & Conditions govern all purchases made through our website, offline stores, pop-up stalls, exhibitions, events, and Shopify POS systems.

By making a purchase from Mitty / Mitty Agritech through any channel, you agree to be bound by these terms.

For the purposes of these Terms & Conditions, the following definitions shall apply:

1) “Company”, “We”, “Us”, “Our” refers to Mitty.

2) “Website” refers to the official Mitty website and related digital platforms.

3) “User”, “You”, “Your” refers to any person accessing, browsing, or purchasing from our services.

4) “Products” refers to live plants, pots, planters, gardening accessories, and related items sold by Mitty.

5) “Services” includes online sales, offline sales, pop-up events, Shopify POS transactions, and customer support services provided by Mitty.


1. Scope of Application (Online & Offline Sales)

These Terms & Conditions apply to:

1) Purchases made on our website

2) Orders placed through Shopify POS

3) Sales at pop-up stores, exhibitions, flea markets, kiosks, and offline events

4) Orders paid via UPI, QR code, card machines, or cash (where permitted)

The same product, refund, replacement, and liability rules apply across all channels unless explicitly stated otherwise.


2. User Eligibility & Obligations

By accessing or using Mitty’s website or services, you confirm that:

1) You are at least 18 years of age, or are accessing the services under the supervision of a parent or legal guardian.

2) The information you provide while placing an order or interacting with our services is accurate, complete, and current.

3) You will use the website and services only for lawful purposes.

You agree not to:

1) Engage in fraudulent or deceptive transactions.

2) Misuse promotional offers, discounts, or referral programs.

3) Attempt to gain unauthorized access to Mitty’s systems or interfere with website operations.

4) Submit false or misleading claims relating to refunds, replacements, or deliveries.


3. Product Nature & Variations

1) Live plants are natural products; variations in size, shape, foliage, colour, and growth are normal

2) Plants sold offline may differ slightly from online images due to availability and seasonality

3) Customers purchasing offline are encouraged to inspect plants and products before purchase

Once an offline purchase is completed, acceptance of the product is deemed final.


4. Pricing, Billing & Payments (POS Included)

1) Prices are listed in INR and are inclusive or exclusive of GST as displayed

2) Prices at offline locations may differ from website pricing due to logistics or event costs

3) Payments accepted include:

A) UPI / QR payments

B) Debit & credit cards

C) Cash (where legally permitted)

D) Shopify POS payments

For Shopify POS orders, the digital receipt or invoice generated shall be considered valid proof of purchase.


5. Order Acceptance & Finality (Offline & POS)

1) All offline and pop-up purchases are final at the point of sale

2) Orders placed via Shopify POS are considered confirmed immediately upon payment

3) Once payment is completed, cancellations are not permitted for offline or POS purchases

Mitty reserves the right to refuse service or cancel a transaction in cases of:

1) Pricing errors

2) Stock mismatch

3) Suspected misuse or fraud


6. Shipping from Offline or POS Orders

1) Some offline or pop-up purchases may be shipped later due to inventory constraints

2) Shipping timelines will be communicated verbally or via message at the time of purchase

3) Risk of loss transfers to the customer upon handover to the delivery partner or upon collection


7. Returns, Refunds & Replacements (Offline Specific)

Live Plants

1) Live plants purchased offline or via Shopify POS are non-returnable and non-refundable

2) Replacement is not applicable once the customer has inspected and accepted the plant at the point of sale

Non-Plant Items

1) Pots, planters, and accessories purchased offline are non-returnable, unless:

A) The product has a manufacturing defect

B) The issue is reported within 24 hours of purchase with proof

Replacement approval remains at Mitty’s sole discretion.


8. Events, Pop-Ups & Exhibitions

1) Products sold at events or pop-ups may be event-exclusive and non-repeatable

2) Promotional pricing offered at events is valid only for the duration of the event

3) Mitty is not responsible for plant health issues arising due to post-event handling, transport, or environmental exposure


9. Third-Party Links / Services Disclaimer

Mitty’s website or communications may contain links to or integrations with third-party platforms, including payment gateways, logistics partners, analytics tools, or social media services.

Mitty does not control, endorse, or assume responsibility for the content, terms, privacy policies, or practices of any third-party websites or services. Your interaction with such third-party platforms is at your own risk.


10. Termination Rights

Mitty reserves the right, at its sole discretion, to suspend, restrict, or terminate a user’s access to the website, services, or purchasing privileges, without prior notice, if:

1) These Terms & Conditions are violated.

2) Fraudulent, abusive, or unlawful behavior is suspected.

3) Repeated false claims or misuse of refund, replacement, or promotional policies occur.

4) Any activity is found to be harmful to Mitty, its customers, or its operations.

Termination shall not affect any rights or obligations that arose prior to such termination.


11. Modification of Terms

Mitty reserves the right to update, modify, or replace any part of these Terms & Conditions at any time.

Any changes will become effective immediately upon being published on the website. Continued use of Mitty’s website or services after such updates constitutes acceptance of the revised Terms & Conditions.


12. Limitation of Liability (Extended)

Mitty shall not be liable for:

1) Plant stress or damage caused by transport after offline purchase

2) Improper handling by the customer post-purchase

3) Environmental factors such as heat, cold, humidity, or pollution

4) Loss or damage once the product has been handed over physically or shipped

Maximum liability, if any, shall be limited to the product’s purchase value.


13. Intellectual Property

All brand assets, including logos, signage, packaging, displays, and content used online or offline, remain the exclusive property of Mitty Agritech.

Unauthorized use is strictly prohibited.


14. Third-Party Links / Services Disclaimer

Mitty’s website, applications, communications, or services may contain links to, integrate with, or rely upon third-party platforms or service providers, including but not limited to payment gateways, logistics partners, analytics tools, hosting providers, and social media platforms.

Mitty does not own, operate, control, or endorse any such third-party platforms and makes no representations or warranties regarding their availability, reliability, security, accuracy, legality, or performance. Use of any third-party platform or service is entirely at the user’s own risk and subject to the terms, conditions, and privacy policies of the respective third parties.

Mitty shall not be liable for any direct or indirect loss, damage, delay, failure, interruption, data breach, or dispute arising out of or in connection with the use of, or reliance upon, any third-party platform or service, including but not limited to payment processing failures, delivery delays, data handling practices, or service outages.


15. Termination Rights

Mitty reserves the unconditional right, at its sole and absolute discretion, to suspend, restrict, or permanently terminate a user’s access to the website, services, account, or purchasing privileges, with or without notice, for any reason including but not limited to the following:

1) Breach or suspected breach of these Terms & Conditions or any related policies

2) Fraudulent, unlawful, abusive, deceptive, or harmful conduct

3) Misuse or abuse of promotions, refunds, replacements, or return mechanisms

4) Submission of false, misleading, or bad-faith claims or information

5) Conduct that may adversely impact Mitty, its customers, partners, operations, or reputation

Upon termination, Mitty may cancel or refuse to fulfil any pending or future orders, deny continued access to services, and take any lawful action deemed necessary. Termination shall not limit or waive any rights or remedies available to Mitty under applicable law, and all provisions which by their nature should survive termination shall continue to remain in effect.


16. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of courts in New Delhi, India.
